Over the past ten years, we have been on a trajectory to use behavioral data as a raw material for markets. Data is a raw material that offers opportunities to know society, to influence and generate value in society, so it can have an important impact on power relations.
The analysis of the behavioural data can bring benefits, for example, by analyzing bus access behaviors, we can reinforce the frequency of buses in times of greater influx of people. But the performance of behavior analysis can be economic or political, oriented towards the accumulation of powers.
In Europe we have a law that began to take steps four years ago: GDPR (General Data Protection Regulation). Well, the European Centre for Digital Rights has conducted a study on this law and the market dynamics regarding data, and has shared the conclusion that the data industry has learned to live with the GDPR without profound changes in its business dynamics.
Here are two ideas he highlighted. The GDPR is still not fully understood, and is considered a threat by many actors by undermining the fundamental rights it protects. Control of non-compliance is becoming increasingly difficult due to the lack of transparency and the dynamics of digitisation technologies.
Another idea that interests me is that the nature of personal data is changing, and in that sense, the GDPR should be a living law for these times.
The digital implementation of the fundamental rights of data, and of the conduct being analysed, will not be easy, as most of the technology they generate when shaping our digitisation is geared towards the exploitation of data. Therefore, the GDPR and other laws will always remain behind. We must therefore learn to defend this right, either by regulating what exists, or by adapting it to the exploitation models of the nature of PRD data. And also through the creation of models that more ethically understand technology and digitalization.
