Either it's tortured by Civil Guards, Police and Ertzainas, or it's been tortured, at least between 1960 and 2013. In order of whom, who authorises it? What is said in these lines is still dangerous in Spain, one can receive a complaint from the State or be arrested. There is nothing more to do with what the Delegate of the Government of Navarra did with the painted Aztnugal de Burlada: several citizens detained by a simple painting.
The Directorate of Peace and Coexistence of the Basque Government has commissioned the “Torture: 1960-2013” shows a total of 4,660 cases of torture among the CAV population during this period of time. The research has been developed by the Basque Institute of Criminology, and is directed by the well-known forensic physician Paco Etxeberria. By December all the research will be completed. According to the Group against Torture, up to 10,000 cases of torture and ill-treatment can be increased in Euskal Herria. When such an investigation is launched, moreover, many people may still appear who have not suffered or reported torture, driven by the conditions of the new environment.
Who tortured her? In 1,589 cases the Civil Guard, the National Police in 1,561 and the Ertzaintza in 310 cases. How have these torture been investigated and punished? Between 1960 and 2013, the Spanish courts have sentenced 50 officials for torturing 32 people, all between 1979 and 1992, and since that date there have been no convictions. Of the torture cases of the Ertzaintza not only have they been punished, but, paradoxically, the Basque Government has always denied that the Ertzaintza has tortured.
The Basque Government is the most representative higher institution that has accepted torture in the Spanish State, and this report will mark a turning point in the knowledge of it. The Director of Peace and Coexistence of the Basque Government, Jonan Fernández, has also asked the Spanish Government to investigate torture. Time and the number of torturers indicate that torture has been systematic in Spain, that is, driven and protected by the State, but this has never recognized it, and probably not so crudely.
In the scheme of truth, justice and reparation this government is a very important step, but decades ago in Euskal Herria it has been necessary for the truths of Pernando to be accepted. It is difficult to see Spain fitted into this scheme, without which there can hardly be justice and reparation. But just step by step you can do the entire journey, and that can only be done from the visibilization of truth and the demand for justice. In addition, thousands of tortured people, organizations, associations and the media have reported torture and have filed complaints throughout these years, and will continue to do so, otherwise these reports will remain in the drawer of any government.
The risk of forgetting always exists, among other things because many are not interested in taking off any of that. What hope can we look at Spain? If we were to take a gauge of the dissemination given to the government's report, very little. For example, El País and El Mundo did not mention the issue even the day after the Government made the report known. For El Diario Vasco, the fact that 1,603 Gipuzkoans were tortured earned a 3x4 centimeters degree of skin. Fortunately, the denunciation of the torturers and the work of the citizens and institutions working to make it visible will hardly leave time to devour torture without further ado. The results of the last elections in Spain are not very encouraging either.
Many people have suffered torture and many people are still suffering its consequences, including many of the prisoners who have been sentenced for torture. The review of these sanctions and the cessation of new counts of torture are some of the first steps to be taken. n
