In June the law was passed to prevent the use of hydraulic fracture in the CAPV, but this has not altered the plans of the Basque Government, and in particular the Department of Economic Development, which establishes the policy of hydrocarbons, before its approval.
Last week it was learned that the Basque Energy Agency (EVE), under the Basque Government, can focus its projects on a report prepared by the Basque Competitiveness Institute, Orkestra. The report contains all the arguments commonly used by the fracking industry.
In addition, the Orkestra Institute has carried out a new study for the SRE, which will analyse the possibilities of granting financial incentives for fracking. The Basque Government has allocated a minimum of EUR 161,000 to the financing of these studies.
With approximately one month of Basque law on fracking, the Spanish Government has already announced that it would resort to the rule, as it had previously done with other administrations, including that of Madrid Nafarroakoa.Baina, which has not complied with the threat. Instead, the Bilateral Commission on Territorial Cooperation between the Spanish State and the CAV has announced that it will start negotiations on the anti-fracking law. So far, the existence of these negotiations has not been made known, nor has they been initiated.
The PNV, which abstained from voting on the law to prevent fracking, has publicly supported the initiative. That is why the complaint lodged in Parliament by pp. María del Carmen López de Ocariz at the end of October is more serious. López de Ocariz said that the PNV has repeatedly called on the Spanish Ministry of Industry to lodge an appeal against the decision of the Provincial Council of Bizkaia. At the plenary session on 13 November, the Basque Government spokesman, Josu Erkoreka, was asked about these statements, but he did not respond clearly to them.
A few weeks earlier, Economic Development Counselor Arantza Tapia responded to a question from EH Bildu in which she was more emphatic. According to Tapia, the public company SHESA maintains all its projects, including those which provide for the use of hydraulic fracture. The 2016 budget proposal of the Basque Government also maintains expenditure for various SHESA exploration projects.
