Born 27 June 1605. The Navarro gentleman Gaspar Ezpeleta, after having dinner with the Marquis of Falces, went home (to his house or to a woman's house, famous for being a mujeriego). He was in the neighborhood of San Andrés, when he met a man who was there. The man told him to leave, he got engaged in a fight, and finally, the swords were unwrapped. The battle was lost by Ezpeleta and, badly wounded, he began to call for help, screaming. He died several hours later, without pronouncing the name of the murderer.
Ezpeleta's cries woke up to the neighbors. The first to reach the wounded were the priest Esteban of Garibay and the writer Miguel de Cervantes, and the gentleman was taken to the house of the latter. Soon came the mayor and Judge Cristobal de Villarroel, accompanied by two Civil Guard officers. After questioning him, Cervantes and Garibay, Ezpeleta left the scene of the crime without arresting anyone and apparently without a clear suspect.
All the residents of the San Andres neighbourhood knew that Andrés Ezpeleta maintained relations with Mr. Melchor Galván ' s wife, among others, and that Galván himself was the main suspect. But Galván Villlarroel was the judge's mayor and assistant. To protect the assistant and divert attention, Villarroel “invented” other suspects. According to neighboring Isabel de Ayala, the women of Cervantes' house "usually receive visits from knights both day and night", and that was what Villarroel used to argue that the avenger could be Cervantes. On 30 June, Miguel de Cervantes, her sister Andrea, her niece Constanza and her daughter Isabel entered Valladolid prison. Eight days later they were released without evidence against them.
The mayor had no impediment to decree a brief but unfair prison for the Cervantes. Until then, Cervantes did not enjoy the fame that he could later obtain, but the family and Miguel himself had a long list of criminal records. His grandfather, Juan de Cervantes, had entered Valladolid prison for wife reasons. His father, Rodrigo, was also in the same jail for not paying a loan on time. Miguel remained in prison for five years in Algeria after the battle of Lepanto, suffered a brief incarceration in Castro del Río, in Córdoba, whose causes are not detailed in the documents, and went to the Real Prison of Seville for appropriating public money.
Ezpeleta's murder was never cleared up.
