In Navarre, the official start of the works of the High-Speed Train (TAV) has brought with it the scandal of the Yolanda Barcina tarts. The three Navarros activists of the group have been sentenced to 16 years in prison (4+4+8) at the National Hearing in Madrid. The brutal three-tranche attack took place in Tolosa, on the other side of the Pyrenees, at the time when Barcina took over the presidency of the Pyrenees Labour Community, and he could suffer more pain.

The Aferá case has opened legal proceedings in the French State, but also in Madrid just in case. In France, the prosecution is based on a lack of violence and a series of material damage. In the Spanish instruction, on the contrary, the crime of aggression is described to the authorities and Julio, Gorka and Ibán are accused of "force, intimacy and severe resistance". Apparently, the activity that takes place at the parties of any family member or friend could express a criminal sense.

For those of us who have studied law, these legal uncertainties of Spanish justice are not new and are clearly related to the “Basque syndrome”. Opponents of the Basque high-speed project have known on other occasions the processes of criminalization of the National High Court, such as those who sat in a zebra crossing in Ordizia in 2008 and those who were arrested in the Landes de Urbina in 2010.

In theory, the National Court of Madrid is a special Court of Justice for judging drug trafficking and terrorist offences, as well as attacks on the highest institutions of the Spanish State and crimes committed abroad. In this case, the last three appear to be met, according to the Government of Navarra, the main media, the prosecutor and the judge. What a scandal!

The hardest thing is that in our land, at this juncture of profound social and economic crisis and at a time of giant pedagogical-energetic massacre, the authorities of Spain, Navarre and the Basque Country, and various media and social activists, are looking back and do not want to see the economic-ecological destruction. They have been criminalising Basque environmental activism against the TAV for years, but they have not yet drowned the movement. Many people are frightened, of course, but the socio-economic crisis is long and if the social movement grows, we have to see the decline and change of this project. That is the case!
