The majority of the Uliazpi Works Council opposed the Basque judgment. The signatory workers consider this a "serious attack" on workers, users and family members. LAB and ELA hold the majority of trade union representation, with five and three representatives respectively. CCOO has five other representatives and refuses to sign the declaration.
The unions explain that the workers have made a great effort to get a place and have been waiting for more than fifteen years for the OPE. They say that the bases of the call for public posts were unanimously approved by all those who hold trade union representation in the Commission, when the Euskera Plan was approved. "The judgment violates the institutional duty to guarantee the linguistic rights of citizens".
Necessary to communicate with users and families
Uliazpi is a foundation of the Provincial Council of Gipuzkoa that works with people with intellectual disabilities. For this reason, the staff who signed the declaration affirms that knowledge of the language is "fundamental" to carry out educational tasks in order to communicate with users and families. They consider that the sentence "makes a serious mistake" by confusing the right of every person to access public employment with the need to fulfil the conditions for a given post.
Last year, the San Sebastian Court ruled on the possibility of applying for Euskera in competitions to cover 34 places of caregiver at the Uliazpi Foundation. In early March, the High Court of Justice of the Basque Country suspended the judgment on the grounds that making such a linguistic profile to these workers is "disproportionate" and "discriminatory".
The sentence lifts dust. The Provincial Council of Gipuzkoa reported that it would appeal the judgment. The workers also concentrated on 2 March against the judgment.
