The Supreme annuls the express action of the Municipalities in the Basque language
- The High Court of Justice ruled in 2023 against certain articles of the Basque language municipal law, which has now been ratified by the Supreme Court. The Basque Government has not submitted a timely appeal against the ruling.
The Basque Government gave the newspaper Berria some details of what happened and reported that it had filed an appeal for cassation. The PP asked the Supreme Court not to approve this appeal, arguing that it was out of time. And the Supreme Court finally accepts the PP’s request and repeals several articles that regulated the priority of the use of the Basque language in the municipalities of the Basque Country.
On October 19, 2023, the Court of Justice of the Autonomous Community of the Basque Country (Tribunal de Justicia del País Vasco) appealed to the PP and annulled Articles 18.1, 18.2 and 33.5 of Decree 179/2019, which develops the municipal law on the Basque language. These articles regulate, among other things, the preparation of the internal documentation of the municipalities in both Basque and Spanish, but the possibility of writing the acts in pure Basque. One of the judges who made this decision argued that since Spanish and Basque are the two official languages of the Basque Country, it is not possible to "prioritize" one of them.
Focusing on litigation initiated by VOX
However, the Government has stated that this decision by the Supreme Court is not "decisive" for the future of the regulation of the Basque language. In fact, it gives more importance to the litigation that Vox has also launched. By an appeal filed by the same political party, the Court of Justice of the Basque Country ruled on October 17, 2023, the first verdict against the municipal decree on the Basque language:It annulled Article 9.2, the first paragraph of Article 11 and Article 12.
The government explains that for the moment it has not had "incidences" in this litigation, and it is anticipated that the resolution will soon be awaited: "We hope that we will soon have a final verdict on this issue so that we can regain stability and keep the decree in force."
