The High Court of Justice of the Basque Country (TSJPV) notified this week the resolution of the Tubacex case: it annulled the employment regulation dossier submitted by the company’s management in the plants of Llodio (Álava) and Amurrio (Álava), which included the 129 redundancies. By order of the Court, the company should readmit all workers under the same conditions as before.
The court rejected the arguments put forward by the company to justify the case and denied that there were economic, "structural" or productive reasons to justify the adoption of this measure. The defence has added to the argument that Tubacex's leadership "has exaggerated" the losses it has suffered, as reported by the High Court of Justice.
However, the court has rejected a number of arguments put forward by the trade unions in judicial proceedings, including the violation of workers' right to strike and the impact of the proposed redundancies on women workers.
The management, however, has announced that it will appeal the judgment to the Supreme Court. The workers are not going to disrupt the strike, so they will continue to fight until the ruling is taken for granted. Today’s day, precisely, will be the 150th day of strike to be held in the Basque Country.
