Many groups of transgender people have denounced that the merger of the two projects has resulted in the loss of transgender people and the lack of an adequate response to their specific reality, they have denounced. For example, in employment, in education, in health, in sport… they have denounced that the situation of transgender people and the legal protection against this situation has been greatly reduced.
Differences between minors
With the new bill, those over the age of 14 will be able to change their sex in the register without the need for a medical report or medical treatment. In other words, they will be recognized for the self-determination of their identity, provided that parental consent is necessary.
The Naiz Association (Hego Euskal Herria) has criticized the 14 year age increase as a backward step, as in some cases the possibility of changing sex to children aged 11 and 12 has been recognized, according to the Constitutional Court.
According to the preliminary draft, children under 12 years of age are not entitled to self-determination - they will be able to change their name only, so they have denounced that the rights of transgender people have been marginalised until the age of 12. Between the ages of 12 and 14, they must have the approval of the courts (and the parents) to change their sex in the register.
Nonbinary people also complain.
The initial project, rejected by the Parliament of Espiania, concerned non-binary persons and called for the placement of a third box in the ID for non-binary persons. However, non-binary citizenship has completely eliminated new projects, as the collectives have pointed out.
