A number of LGTBI groups in the Basque Country have signed a declaration against amendments restricting Transe’s rights. In particular, Loratuz Lotura, Ser Tu, Dekumas, Fénix, Lumagorri, Transkolore, Kattalingorri, EHGAM, Ozoz! The manifesto was signed by LGTB, Sare Lesbianista and Safika with a clear objective: On the one hand, to denounce the obstacles that the Trans Act is placing in the Spanish Congress and, on the other, to ask the Members of the Parliament of Hego Euskal Herria to encourage their approval.
The associations highlight in the declaration the obstacles that have been placed from the outset in the proposed text in May 2021. They recall that the initial text was first rejected and that the proposal put forward by the Council of Ministers instead included "clear cuts in rights from the original text". "It later took months for the State Council to issue a non-binding report, although the Ministry of Equality urgently dealt with this law. Finally, the parliamentary procedure has begun and the PSOE has extended it over and over again, with the support of the right and the right."
This evolution indicates that the processing of the Trans Act is being conflicting in the Spanish Parliament. Largely because of illegal voices within the PSOE. The amendments seek to limit the rights that the law would grant to trans people. An example of this is the barrier that aims to put gender self-determination, demanding that people aged 14 to 16 need judicial authorization to make changes in sexual mention, as opposed to what the original proposal said.
Faced with amendments such as those limiting the rights of transs, "without further delay", the collective LGBTI of the Basque Country have asked Basque Members to support the amendments aimed at extending the rights of transs. In this regard, the following requirements have also been made: When the time comes for the vote on the Trans Act, break your party’s voting discipline to adopt an amendment that hinders the rule or limits trans rights.
They have pointed out that the situation is urgent, above all because until the adoption of the law transactions must deal with everyday violence. "Transphobia is a structural violence that permeates our lives at all times, in the workplace, school, health, institutional, etc." They even denounce that the prolongation of the law process and the conflict that has arisen under the law has led to an increase in violence: "It has created a growing enmity every week. They insult us, they despise us and they question us. Trans identities are the subject of tertulias in which everyone has the right to comment, and as this happens, the climate of violence is growing against us. A debate full of lies opens, eager to discredit, to keep moving away from society".
In this sense, they request the approval of the trans collective as "subject of rights". They argue that the right to gender self-determination should be guaranteed as a right enshrined in Basque and Navarre legislation. "If it was possible for the political majority in their parliaments to recognize this right, now why not?" they asked the question.
