The ertzaina who injured the young man with a rubber ball has declared this Wednesday in the Tolosa court. It justifies that the intervention in the carnivals of Tolosa was proportional to the facts. The movement has accused the judge of filing the case with the ertzaina statement and has strongly criticized the closure of the case before Xuhar himself declared.

Villabona's 16-year-old was wounded with a foam shell in the carnival of Tolosa by agents of the Ertzaintza. The young man has been blinded from a right eye because of a rubber ball launched by the Ertzaintza in an altercation of the bar.

The surgical interventions and rehabilitations that began eight months ago have not been enough to regain sight. Both in the ambulance and in the hospital and the reports made by the surgeon show that the wound was caused by the rubber ball, although initially the then Security Advisor, Josu Erkoreka, denied having used grenade launchers in the carnivals.

The popular movement has stressed that they have asked the court for accountability and that the case be investigated with the “seriousness that the case demands”. In view of the judge’s decision, the defence has announced that it will file an appeal of unconstitutionality against the judgment.
