Judge Ismael Moreno, who deals with the matter, has not taken any other decision on it, and according to the news agency Europa Press, he is still awaiting the report requested from the Judicial Police. The National Audience of Spain, accused of "exalting terrorism", began the investigation because the ultra-right party Vox, the Villacisneros Foundation and the Dignity and Justice group denounced the event. Accordingly, the judge convened on Monday, August 22 to declare three members of the Kandaru Cultural Association, responsible for the organization of the event.
The defendants stated that the act held on the fronton of Berango was private, that the doors were closed and that there was no crime. The members of Kandaru Kultur Elkartea have also denounced the "media, political and judicial campaign of criminalisation". On the one hand, they have denounced the performance of the newspaper El Correo, "for its leading role in feeding this campaign". They explain that on the day of the act a journalist from this media entered the pediment and published on the digital portal the name and surname of the three defendants, "who later eliminated". On the other hand, the sanctions imposed by the Municipality of Berango stand out: two three-month vedas for the use of municipal facilities and two fines of 500 euros for pasting the banners on the walls of the pediment and for the "misuse" of the pediment.
On Monday at 20:00, a solidary concentration was held with those charged in the Plaza de los Gudaris de Berango.
The judge of the National Court admitted to investigating the allegations made by the ultra-right party Vox and the Villacisneros Foundation against the act, convening yesterday to declare the three defendants allegedly responsible for their organization. On the other hand, in the complaint made by the association Dignity and Justice, he stated that "more than 200 people who were in the welcome to Aginaga made a corridor to the old pressure and sang for the struggle".
For the Villacisneros Foundation, it was a "clear" gout of terrorism, "typified in article 578 of the Penal Code, so public institutions are urged to prevent it". They also asked the Basque Government, the CAV Government Delegation and the Berango City Hall to ban such acts.
The three abovementioned whistle-blowers requested the Spanish National Court to prohibit it before the event was held, which it did not consider appropriate.
