According to the complaint, the child had been sexually assaulted for two years by the man under investigation. When his mother was going to work, he was staying at home taking care of his child, and he was supposedly taking advantage of those moments to do sexual assaults. According to the child's complaint, the last assault took place in the 2022 Christmas Eve, but the child informed his mother of what happened on January 8; the complaint threatened him by saying that if he counted anything his mother would break the console.

The private accusation requested the inclusion of the alleged aggressor in prison, but he is still temporarily released, his passport is removed, he cannot leave the Spanish State and must go to court every fifteen days, according to the order of 10 January. In the same car, the investigating judge ordered the statement from both the man and the child. He also asked the court's psychosocial team to prepare a report on credibility and psychological impact. However, although the child's lawyer asked, the instructor did not order a forensic examination.

Since then, the lawyer has requested at least four more times the forensic examination, which was finally approved by the instructor on 30 January and ordered. But they haven't done it yet. The indictment says that what is happening is “worrying and serious”, and that it is important to do a forensic analysis, because it would be an “objective” element of “ratification of facts”. He also denounces that he is “letting time go”, which means “the possibility of healing cracks or any hint of the fact”.
