Food distribution staff in hospitality establishments via digital platforms has been incorporated into the CAPV Framework Agreement on Hospitality. From now on, Rider’s working conditions will be governed by the hospitality agreement. The agreement was signed on 28 June by the unions ELA and LAB, the central management of the Basque Country, the Federación de Hostelería de Euskadi y Confebask.
According to the LAB union, with this agreement, Rider will join the third category or the group in which he integrates. The wage will be regulated from EUR 18,700 to EUR 21,500/year if it is carried out full-time, and the working day will be from 1,723 to 1,750 hours. They will also be given the right to subrogation and the regulation that suits their work “to increase the protection of workers” will be incorporated.
The adoption of this Convention excludes the possibility of implementing other agreements. Thus, the Home Distribution Convention or the State Messaging Convention in Bizkaia Supermarkets will not apply to distributors via APP.
ELA considers the agreement to be a step forward: "Because it is the way to deal with the precariousness of a group that has a high risk of exploitation." The union will encourage minimum wages to be above EUR 1,200 per month in the Basque Country as a whole. ELA points out that the precedent of this situation is the first agreement signed by an absolute majority for workers distributing their purchases in supermarkets.
The agreement comes after the demands that the LAB syndicate has begun together with the Riders X Derechos group. Rider’s work premiered in 2018 in the Spanish state, and since then several attempts have been made to denounce the precarious working conditions of these “false self-employed.” On 23 September 2020, the Supreme Court ruled that Rider’s relationship with digital platforms is labour and that such workers are employees of the company and non-self-employed.
