The Social Court has condemned the Port Authority of Pasaia and the Algeposa group to compensate the worker's family with EUR 166,745.45 for non-compliance with their obligation to protect occupational risks and, consequently, for the death of a local worker due to lung cancer.
After working in the Biyak Bat bin, since 1985 he worked in the port of Pasaia and in the plant of Algeposa, repairing and modifying brake pads for cranes and commercial vehicles exposed to asbestos.
In 2021, he was diagnosed with lung adenocarcimoon due to asbestos at Donostia Hospital, but was not found to be suspicious, and ASVIAME has denounced collaborating in the concealment of cancer. After his death in 2022, Osalan included him in the file of workers exposed to asbestos in 2023.
ASVIAME has denounced that Osakidetza helped hide cancer from work. The association has called for Osakidetza to stop being complicit in the concealment of occupational cancer, as it encourages companies to avoid preventive measures for workers working with carcinogenic substances.
ASVIAME has shown its satisfaction with the ruling, as the violation of measures against occupational death has become evident. According to the European Commission, 52% of deaths at work have been caused by cancer.
