The resolution of the Spanish National Court notified on Wednesday annulled the statutes that the other union registered in the month of August. According to the resolution, Spanish legislation prohibits work contracts related to prostitution, since it does not understand that it is a job and therefore does not attribute it any union rights. The National Court considers that the approval of the union’s statutes would give pimping the legal status necessary for its materialization.
Although the court acknowledges that union is a fundamental right, it argues that that right can only be exercised when someone has the status of worker, and suggests that sex workers are outside that status. She reported that OTHER “includes actions that can be carried out in the context of the employment relationship”, such as pornography, but the sex work between them is not valid for an employment contract.
The resolution of the Spanish National Court does not mean the dissolution of the union, but the annulment of the fourth article of the statutes. This article includes sex work as part of union activity.
The members of the OTROS trade union have reported that they intend to appeal against the decision annulling their statutes before the Spanish High Court of Justice for appeal.
