The Administrative Tribunal of Navarra raises 10% to 2.74% in the valuation of the Basque Country
The City of Burlada, until its modification by UPN and PSN at the end of its previous mandate, had a very good Organic Staff in relation to the Basque Country: in some positions it was essential to know the Basque Country; in others, it had as merit the knowledge of the Basque Country, with a value of 10%; in the rest it was also merit the knowledge of the Basque country5%.
In March 2023, the City of Burlada obtained a call for employment for the provision, through a promotion competition, of two Agent Primer seats of the Municipal Police.
He requested the knowledge of the Basque Country in a job, as established in the Organic Staff. For the other position, it was established that the value of the Basque knowledge as merit was 10%.
However, the City of Burlada established a value of 2.74% for the Basque country (8.25 points out 301’50).
Of course, with the decrease in the value of the Basque Country, the possibility of providing a bilingual service in this municipal police station was reduced. A citizen of Burlada therefore appealed to the Administrative Court of Navarra.
On 20 December 2023, the Administrative Tribunal of Navarra gave its agreement: the City of Burlada has not valued 10% of the total points but 10% of the points of merit; since there are no rules to determine how to apply 10%, it takes good municipal conduct, which is free to do so.
And everyone believes it has turned the worthless organic template into a good Organic Template. In this case 10% has turned it into 2’74%, but if the merits had been 8 points instead of 81’5, that 10% would be 0’35%. Calmly, the Administrative Court of Navarre has decided that what is regulated in the organic staff can be used as a gum and that the Basque score has no guarantee.
The ruling of the Administrative Court of Navarra was shameful. Once again, the Basques have mocked us. Once again, when interpreting the rules, the rules lose all the guarantee for the Basques.
Faced with this, we Euskaltzales must protest loudly.
