The Court of Inquiry No. 4 of Donostia-San Sebastian has completed the investigation of the main trial against Kote Cabezudo. Courts of Investigation. Judge Jualián García Marcos has investigated the case and is charged with a total of 47 crimes for which he is charged. The photographer, charged in the case, will be tried, although at the moment no date has been made known. The private prosecution expects the trial to take place before the autumn, as reported by the Prosecutor’s Office in a statement.
Cabezudo, who for years worked as a photographer in the fashion world, was recognized in his practice and revolved around the political and business elite of the Gipuzkoan capital. However, in recent years there have been many women who have filed complaints about sexual abuse and/or the dissemination of photographs that appear naked without their consent.
The judge considers that crimes against sexual liberty in four of the cases are crimes against moral integrity in five of the five; in eight cases, the prohibition of minors; in thirteen cases, the violation of privacy; and in seventeen cases, fraud. In the case of some women, the Police has identified several persons as alleged perpetrators of crimes.
The trial against the photographer, which has just been closed, has been divided into several pieces, including several. The first trial was held in January, in which Cabezudo was convicted of terrorist offences. The court tried to spread photographs of a naked woman on the net, and the court proved that the photographs that appeared on the net had been taken by Cabezudo, the model, 20 years ago. The court charges him with a crime of coercion and obstruction of the work of the judiciary. Although the private prosecution also charged him with a crime against privacy, the court acquitted him.
The offence of coercion was sentenced to two years and three months in prison, a fine of EUR 5,040 and a compensation of EUR 8,000 for the moral damage caused to women.
Cabezudo has been in pre-trial detention since May last year, in Martutene prison in Donostia-San Sebastián.
