Karlos Apeztegia has served 26 years in prison. He first stayed in several prisons between 1991 and 2013 and was released during his stay at the Puerto de Santa Maria prison in Cadiz. Five years later he was arrested again in Hernani in 2018 while working in the Etxerat association of family members of prisoners. He was accused of having opened a communication channel with ETA’s leadership in the 2000s, being held prisoner, to propose attacks on prison officials. This leads to another four years in prison.
The Basque Repatriation of Basque prisoners continues and on Thursday the Spanish Penitentiary Institutions and the Basque Government announce the repatriation of eleven Basque prisoners. The destination of each of them has not yet been specified. Julen Atxurra and Beatriz Etxeberria will be imprisoned in Euskal Herria from the Dueso prison in Cantabria. Beñat Aginagalde and Mattin Sarasola from Dueñas (Palencia). Gurutz Agirresarobe, Asier Arzallus, Harriet Iragi, Iker Olabarrieta and Andoni Otegi from Logroño. Iratxe Sorzabal, Jaione Jauregi and Itziar Moreno from Madrid. Moreno is serving the sentence of 15 years in prison imposed in France.
Jon Agirre (Aramaio, 1942) served 30 years in Spanish prisons. He was arrested in 1981 and was released in Basauri prison in 2011. He was born in Aramaio, but before and after entering prison he lived in Arrasate. In fact, in 2006 it was up to him to release, but with the doctrine 197/2006 he was sanctioned. This doctrine extended the punishment of dozens of prisoners.
According to the Penal Code of 1973, the prison benefits were applied to pensioners from the maximum penalty of 30 years until then, but with the new doctrine, the prison benefits would be applied to them, including the cuts of the year, of the total penalty received, that is, from the age of 70, from 500 per 100 or whatever. According to this, the pensioners in 1973 had to serve in full the penalty of 30 years in prison. Subsequently, in 2013, the doctrine was rejected by the European Court of Human Rights in Strasbourg, and the Spanish State had to release a large number of prisoners. As a result of this doctrine, Aguirre remained in prison for five more years than he was.
