The State Attorney asks Junqueras to be able to act as a MEP
- On Monday morning the Spanish State Attorney asked the Supreme Court to release Oriol Junqueras to take the MEP document.
The Lawyer considers that the independent leader of ERC has the right to exercise as a MEP unless the European Parliament withdraws immunity from him. The Attorney General has also asked the Supreme to ask the House of Europe to withdraw immunity from junqueras after their arrest. Throughout this process, junqueras have the right to exercise parliamentary functions, something that should be guaranteed.
Attorney Rosa María Seoane, who participated in the trial as a State lawyer in the Catalan independence case, has signed a letter addressed to the Criminal Chamber of the Supreme Court, detailing that the Supreme’s job is to guarantee the rights of Junqueras and to determine the measures to be taken to prevent their escape. The Attorney General says that the rights of junqueras were violated, but that the judgment against the independentists cannot be questioned and that, therefore, he has to comply with his sentence.
The letter recalls that in the event of a conflict of rules between the Spanish State and the European institutions, European resolutions are binding on the Spaniards.
