The Spanish National Court Denies a Prisoner the Opportunity to Change Degree for the First Time
- The National Court denies the change to the second degree to a person imprisoned in the Córdoba prison and keeps him in the first degree.
After last year’s reflection by the Basque Political Prisoners Collective (EPPK), the prisoners decided to make attempts to improve their situation in accordance with the laws, and many demanded a degree change. They have appealed to the General Secretariat of Prison Surveillance of Spain, which has denied numerous requests. The news reports that last March about 120 prisoners made requests for a change of grade, and 54 of them were denied the request.
The prisoner of Córdoba was the first to appeal to the Spanish National Court and was the first decision of Section 1 of the Criminal Court on the question of degrees. The prisoner, twenty years old in the first degree, and first by the General Secretariat of Prison Surveillance of Spain and then by the National Court, did not accept the request.
According to the ruling of the National Court, “the arguments that have been used to deny the change of degree have been: To be a member of the terrorist organization ETA, because there is no proof of disconnection or attempt to reparate the victims.” He added that “there is a very high risk of relapse.”
The next step would be to file an application for amparo with the Constitutional Court. If rejected there, the Strasbourg Court of Human Rights could be the last option.
In the first degree, inmates spend twenty hours a day in solitary confinement under strict security measures.
