Supreme confirms 28-year condemnation of photographer Kote Cabezudo
- The photographer is charged with abuse, rape, child pornography and model deception. The defendant's defense demands that the law "It's just yes," but they reject it.
The Supreme Court confirms the 28-year prison sentence against photographer Kote Cabezudo. It is punished for a number of crimes of a sexual nature, such as sexual abuse, rape, six and models related to child pornography.
In June 2022, the Provincial Court of Gipuzkoa imposed 28 years and 2 months of imprisonment on the Donostia. However, given that the sentence exceeds the maximum 20 years allowed under the Penal Code, it must not serve the immediate superior years and will take into account the five years in prison. The first complaints against Cabezudo were filed in 2013 and has been in provisional prison since May 2018.
They took into account the allegations of seventeen women, which forced each victim to be compensated with EUR 116,000. He was acquitted of another 217 accused crimes.
The Donostiarra photographed models, often smaller. During the investigation, pictures of naked girls and minors were found on the Cabezudo computer. They also reported that some victims had been touched by Cabezudo. Many stated that when they were minors the photographer ordered them to pose in pornographic positions.
In the case of pornography, Cabezudo justifies that the photographs are not "child pornography" and removed them with the permission of the models. He says that photographs are "artistic" and have no "sexual purpose". The Supreme denies the Cabezudo's argument.

The photographer's defense not only appealed to the judgment of the Court of Gipuzkoa, but also urged the application of the law "only is yes", with the aim of reducing criminal penalties. The Supreme points out that the judgment of the Court of Gipuzkoa is not final, so the new rules cannot be applied. However, the judges stress that even if the new rules were applied, the prison sentence would not change, as the sentence would reduce it to 25 years and exceed 20 years.
