Since the first legislature, it has committed itself to developing this law and is currently in the drafting phase. However, the deadline for its submission in December will prevent Parliament from completing the entire processing process, even if the government has an absolute majority with the support of the PNV and the PSE-EE.

As ElDiario has announced, Urkullu has shared with the Basque Parliament a wealth of documentation, including a legal report prepared by the official Irantzu Zabala Errasti. In this document he proposes that the law be the Law of the Basque Agency for Transparency and Transparency, with an amendment to the title. It also calls for the inclusion of regional bodies in the scope, such as the Basque Parliament, the Consultative Legal Commission of the Basque Country, the Ararteko and the Basque Court of Public Accounts.

The report calls for the legal requirement of "right of access to public information" and "obligations of active publicity", which entails the provision of internal economic data. It also requires “greater precision” in the definition of “infringements”.

The document states that in the CAPV a more “concrete” scope should be determined by the application of the Spanish State legislation to the Royal House, the Courts, the Ombudsman, the Court of Auditors of the Kingdom, the Bank of Spain and the judiciary. The initial proposal of the PNV advisor, Olatz Garamendi, brought together the regional administration, local authorities, the public university (UPV/EHU) and two consultative bodies; the Economic and Social Council (ESC) and the Council for Labour Relations (CIP).

The Autonomous Community of the Basque Country is an exception in the Spanish State, with the exception of Ceuta and Melilla, where the other regions have their own transparency regulations.
