The Prosecutor's Office investigates irregularities reported by LAB in the works of the island of San Sebastian
- LAB of the City of Donostia-San Sebastian allegedly found irregularities in the award of the works of the island of Santa Clara and handed them over in June to the mayor and the Public Prosecutor’s Office. The Public Prosecutor’s Office, for its part, has decided to open proceedings, as ARGIA has learned.
The Abertzale syndicate identified two crimes that were made available to the Prosecutor ' s Office of Gipuzkoa and the Abertzale syndicate. In the dossier prepared by the trade union section of LAB for the staff of the City Hall it was stated that supposedly the companies LKS and Fhecor obtained without bidding the drafting of the execution project and the technical direction of the rehabilitation of the building. From this function, these companies recognized the 23% overexpenditure by the company Moyua, with the approval of the director of the project and works department of Donostia, Alfonso Vázquez.
The mayor of Donostia-San Sebastián, Eneko Goia, pointed out that in the Hondalea project, as in the rest of the projects of the city, "the procedures established through the resolutions of the municipal government regarding concurrence and award have been implemented" and "never opposed to this report of the secretary and the financial controller, so we understand that the legal precepts are followed". Should the City Hall be transparent and the Prosecutor ' s Office decide to request it, he indicated that the relevant files would be sent to him.
According to ARGIA, this will be the case, as prosecutor Juan Calparsoro has decided to put the LAB complaint into value and to open investigative proceedings against it.
In the opinion of LAB, the fact that the drafting of the draft execution of the Joint Project and the technical direction of rehabilitation have been entrusted to LKS-Fhecorri without bidding entails an irregularity in the management that could constitute a crime. “The City Council approved the report that had been processed for the approval of the project, but it did not establish any award for the management or for the drafting of the project. It was the Project and Works Manager who in this situation processed this work to LKS-Fhecor,” they point out. In addition, the company itself LKS has acknowledged that it has carried out this work on behalf of the City Hall and LAB will report that, in its opinion, behind this behavior has been an abuse of its functions, which could even be prevented.
On the other hand, the union has also denounced the misuse of public funds. LAB says that the cost of managing the rehabilitation work of the LKS-Fhecor Island building has been borne by Alfa Arte. The project was presented by Alfa Arte and in the previous one there was no departure for the direction of LKS-Fhecor. “If Alfa Arte has paid these expenses from his departure, it is because the Project and Works Manager has requested it, and we think we are facing a second irregularity, there has been a misuse of public money from the Municipal Budget,” says LAB.
