The Constitutional Court revokes the ban on leaving home in the state of Sarre, Germany
- In the state of Sarre, the ban on leaving the house has been immediately suspended at the request of the Court of Appeal, which planned to do so until 4 May. The TC has responded to the constitutional complaint of a citizen who considers that this measure "has violated fundamental freedoms" and has not been appealed. Citizens will be able to leave their homes when they wish and meet with their families, always respecting the safety distance.
This is the information collected by the Der Spiegel medium. The Sarre Constitutional Court handed down the judgment on 28 April in the Supreme Court. Hours earlier, the Government had announced that it would extend the confinement until 4 May. Following the court ' s decision, a representative of the Government announced that he would comply immediately.
As a result of an emergency complaint lodged by a citizen
A citizen filed an urgent constitutional complaint and requested a court order against this ban. The court considers that "his fundamental right to freedom was violated". The court notes that the measures taken by the Government respond to the situation, as the number of infections in El Sar was quite high. But that, "today, there are no reliable reasons to maintain Sarre's strict regulations that prohibit leaving the house."
Citizens will be able to meet with the family and stay away from home
From now on, citizens will be able to meet with their families and stay away from their homes, always within the security distances. Since March 21, in El Sar had a confinement like the one we know in the Basque Country, to leave the house they needed one of these reasons: going to work, making basic purchases or going to the doctor.
