Numerous judgments have been delivered in recent months against the language profiling schemes established by the administrations in the calls for employment and recruitment. In the last known case, a Municipal Police officer working at Erandio attempted, by means of an appeal, to dismiss the compulsory level B2 level in the post he had been occupying. The city council failed to approve the request. After going to the Court of Justice, you are now right.
Iñigo Urrutia, professor and lawyer at the UPV/EHU expert on issues related to linguistic profiles, announced Berria that the resolution "is another sign of aggression".
The Judgment mentions the arguments of the judgment of the High Court of Justice of the Basque Country of March against linguistic profiles for the exercise of the Uliazpi Foundation. Urrutia points out that the jurisprudence of the last judgment goes along these lines. He argues that, although it is a "different" case, it is not a public job offer but a "judgment against an amendment" in the RPT.
Urrutia believes that the characteristics of linguistic profiles should be met "objectively". In this case, the sentence says that since the municipal police that covers the post is not Euskaldun, "the city council cannot make an adaptation to it". The lawyer therefore stresses that he has opposed municipal autonomy.
The sentence mentions the age of the municipal police from the age of 45. Urrutia explains that above this age they are not obliged to prove the profile, but considers that "age should not limit the linguistic profile of the position".
