Ecologists believe that it is "logical" for the ownership of the plot to be the responsibility, but denounce that the waste remains there illegally. As explained, in September the City Council was asked whether it had asked the owners to withdraw the waste, and the City Council received the following reply: “The area is not municipal property, so it does not appear in the road cleaning and waste contracts of this City Hall.”
Thus, Eguzki concluded that the City Council has not requested the removal of the waste, so it considers that it is acting as “bewilderment”: “The Waste Act expressly prohibits the “abandonment, dumping or uncontrolled disposal of any kind of waste” and makes it sufficiently clear that competition, in cases such as the Closure of Oria, is from local entities, municipalities and communities. The Municipal Waste Collection Ordinance of Donostia-San Sebastián does not, of course, allow waste to be abandoned anywhere and in any way.” That is why the environmental organisation has stressed that the City Hall must oblige the owners to remove the waste: “The City Hall should not look the other way, because these wastes are as illegal as if they were in Alderdi Eder.”
