The Supreme Court of the Basque Country has ruled against the Basque Plan of the Provincial Council of Gipuzkoa
- It has repealed five articles, including administrative procurement and eligibility requirements. The court will appeal the verdict.
The Director of Linguistic Equality, Mikel Irizar, points out that in the High Court judgment technical reasons are often used and that the wording is interpreted narrowly: “The arguments in the ruling to overturn these articles do not contradict the fundamental criteria of our language policy.” In the opinion of Irizar, in the five annulled articles, the court has seen in danger the rights of the citizen who wants to establish relations with the administration in Spanish. The Provincial Council stresses that there have never been any complaints from citizens who want to have relations in Spanish, while “we have received complaints and complaints from citizens who want to have relations with us in Basque”.
The five annulled articles and the issues contained therein are: institutional communication (5. of the Art. ), administrative contracts (8. of the Art. ), the requirements of the recipients of the subsidies (Article 9.3. ), publications (11. In accordance with Art. (c) and the Internet and intranet networks (13. of the Art. ).
The Euskara Plan will be finalised in the remainder of 2017 and technical adaptations will be made to the articles cancelled by the Provincial Council.
UEMA considers the sentence to be very serious
UEMA, the Commonwealth of Basque Municipalities, stresses that the High Court has argued that the preference for Basque violates the “rule of co-officiality”. UEMA recalls that the Provincial Council of Gipuzkoa decided to make Basque the default language in the 2013-2017 Basque Language Plan.
Ten municipalities have received sentences along the lines of the one received by the Provincial Council for giving priority to the Basque language. Thus, UEMA recalls that the delegation of the Government of Spain has filed requests and appeals for the reception of acts in the municipalities in pure Basque or for the prioritization of Basque in public subsidies.
