Cabacas family members and defense lawyers have appeared at a press conference in Bilbao, a day after the Provincial Audience of Bizkaia condemned and acquitted an imputed ertzaina. A legal reading of the judgment was made at the meeting, an assessment of the judgment and a clarification of its future claims.
Attorney Jone Goirizelaia has been the first to take the floor to assess the National Court’s ruling. He points out that one of his demands was for the judgment to recognize exactly what happened. In this regard, they welcome the coincidence of legal truth and facts to a large extent. He underlined the importance of underlining this aspect, noting that the judgment states that the measures taken by the Ertzaintza on the night of 5 April 2012 were not necessary or proportionate and that the murder of Iñigo was caused by the erroneous decisions taken. He has highlighted all this, bearing in mind, in his words, those who have so far moved in many areas and on the lips of many people.
They find it remarkable how the Ertzaintza's work has been valued. He has made it clear that the police intervention was inadequate and that it was possible to do things differently, suggesting that if the Ertzaintza did things well, there would be data to know who the responsibility is.
“What we have always wanted to raise is that in this trial there are not all (…) and also those who were upstairs (in the charges) have responsibilities,” the lawyer insisted, emphasizing that his long struggle has gone in that direction. He adds that the judgment recognizes that not all those responsible for the event have been in the trial, which shows a path of investigation.
Goirizelaia has acknowledged that the sentence imposed by the sentence is small compared to what they requested and that they cannot be said to be satisfied. However, after analysing the judgment, he has reiterated his intention to appeal to the Supreme Court, since, in his view, there are many things to deal with in this regard.
The father of Iñigo Cabacas, Manu Cabacas, has first thanked all the people who during these six years have supported and supported them. He pointed out that to date it has been "a road full of obstacles" and added that it would not be possible to reach where they have arrived without help.
After thanking him, he has questioned a number of political leaders. He heads to Rodolfo Ares, then Interior Minister. He has denounced that the counsellor attempted to divert attention from the alleged incidents that occurred throughout the morning. Now the judgment makes it clear that these incidents never occurred. That being so, will Mr Ares give us an explanation? ".
He then addressed Iñigo Urkullu, Estefanía Beltrán de Heredia and Jonan Fernández and asked them to “please read the judgment”, pay attention to several issues: That the Ertzaintza intervened incorrectly, that evidence has been hidden, that it has been lying since the beginning of the trial, and that it has been committed to shirking responsibilities, among other things. "Are you going to give us any explanation about the Ertzaintza operation?" he asked. He also referred to the lawyers of the Basque Government: “They have tried to justify for six years what happened.”
He also referred to the Public Prosecutor’s Office, and in particular to the prosecutor who has brought the case. He has denounced that he has not asked for evidence in six years and that he has shown a passive attitude and asked how it is possible to say that there is no crime, when judges also say that there is crime. "Don't you have to give explanations? ", says Cabacas.
Urkullu, Beltrán de Heredia and Fernández have stated that they have been “deceived” and that they would like to know the reason for their action: "Why have we been treated so badly?" Are we not all equal? ".
Finally, he has been convinced that this is the case for Iñigo, the only son of both, who will continue to fight until now.
