1st Instruction from Pamplona. The National Hearing investigates the case, which began last year in 2016. On 8 December of the same year, two women were raped in a dwelling in the Erripagaña district. The women met with three men at the Otaño bar, including a Foral Police officer. The next day, the women woke up in a house with injuries and without remembering anything that had happened the night before. As can be deduced, the rapists used some substance for the women to lose their knowledge.
The National Police received a report from the doctor who warned of the possible existence of a rape as a cause of the injuries suffered by women, and opened an investigation on 19 December. In a few days, on 24 December, the women who suffered the aggression also declared themselves as witnesses.
Two days later, on 26 December, the National Police arrested two men for their alleged connection with the rape of minors. The judge of the court took a photograph found on the motive of one of them: At the site was the daughter of a National Police officer, who has died. It has been reported that this agent and one of the detainees in connection with the case are minced.
The brother-in-law of the rape assured on 23 December that he was ill, on the eve of his statement by the woman. The agent had not returned to work until 2 January, so he did not participate in the investigation of the case. However, the WhatsApp group was aware of the details of the case to which it had access, and it was reported that records and arrests were to be made. According to the judge, "it is proven that the defendant read these emails and that, therefore, despite being on vacation, he was aware of the investigations being carried out". And he adds that, with the name of his brother-in-law, he carried out searches in police applications between 13 December and 27 January.
Thus, it is believed that this agent informed his brother-in-law of the details of the investigation and that this conviction started the second line of investigation, related to the attempt to cover up the violation. Upon completion of the investigation, the case is awaiting trial. The particular accusation, which represents women, calls for four and a half years in jail for revealing secret information and for failing to comply with the duty to follow up crimes. The Prosecutor’s Office, for its part, has called for Miguel Strogoff’s acquittal on the grounds that, despite suspicions, there is no evidence.
The rape investigation is still ongoing.
Some of the tests that might be used to clarify the case have been removed. The results of the recall of the mobile phone of one of the accused have disappeared, as well as the images of the camera of the bar Otaño. The files of the police unit investigating the case are also missing.
