“There is a great lack of legal consistency in characterizing this as a terrorist attitude and demonstrates the weakness of the magistrate’s arguments,” writes Garzón. The article states that “the granting of a terrorist character to the collective Movimiento Ospa, as done by the judge and the prosecutor, would imply that its terrorist objectives should be fully defined, as required by Article 373 of the Criminal Code. But it's not like that. Not even indirectly,” he added.
Along with making this statement, Garzón has differentiated the case of Altsasu from the nature of the operations he has launched based on the theory of “everything is ETA”. In doing so, he has also provided some incorrect data, for example, when he said that the Get Out of Here project was created by ETA – as has been clarified several times, the EIA was the first to use the slogan. In any case, Garzón believes that since October 11, 2011, ETA decided to abandon its definitive weapons, it was “emptied” with the armed liaison group of the Get Out of Here campaign.
The judge considers that the prison sentences demanded by the prosecutor’s office for the young people of Altsasu are “astronomical” and has also criticized the Spanish Supreme Court for not stopping “this legal nonsense” when it was necessary to decide whether the case should be tried in the National Court or in Pamplona.
The judge has also gone further, citing the “denaturalization of the concept of terrorism” and setting some examples from recent years: People prosecuted for writing on Twitter, for whistling against the Spanish anthem or for burning the Spanish flag, for example. Other examples of this “denaturalization” that was known much earlier in the Basque Country – journalists, politicians, members of popular movements... – have not been given in the article.
