Within hours of the Supreme Court ' s decision not to review the case of Xabier Atristain, the Basque prisoner has been detained in the Historical Centre of San Sebastian and has re-entered the Martutene prison Naiz.eus.
Atristain was sentenced to 17 years in prison, of which Hambi has incarcerated. He was released on 17 February 2022, following a judgment of the Court of Human Rights in Strasbourg that the matter had to be reviewed.
Strasbourg says that the conviction of Atristain was based solely on the statements made while in the hands of the civil guard, and that the Civil Guard has not explained why it was incommunicado during the detention and, therefore, did not allow him to choose his trusted lawyer.
However, the prosecutor of the Supreme Court has asked the Supreme Court not to review the case and the Supreme Court accepts the petition. He is followed by the arrest and detention of Atristain.
