On 7 May, the exhaust ammonia from the Zubieta incinerator to the Arkaitzerreka regatta killed hundreds of fish. The events were made known thanks to the cooperation of the area’s neighbours. The Gipuzkoa Waste Consortium (GHK) initially denied that the incinerator had anything to do with that landfill, and in the light of the evidence presented, it acknowledged that it had dumped ammonia from the incinerator area.
But subsequently, GHK attributed the responsibility to the company that manages the incinerator. On this subject, EHBildu questioned in the General Meetings of Gipuzkoa the President of the Consortium and Environmental Deputy José Ignacio Asensio. At that hearing, Asensio defined what happened in early May in the Arkaitzerreka neighborhood as a "one-off event." He described it as serious and attributed responsibility to the management company.
In particular, he pointed out that he committed 3 administrative infringements (two minor and one serious). The Waste Consortium of Gipuzkoa has taken a new step by imposing a fine of EUR 45,000 and a fine of EUR 25,000 on the company Ekondakin for failing to report the discharge of ammonia. The GHK considers a serious infringement. EUR 10,000 fine for not communicating the modification of the cubeto design; EUR 10,000 fine for not checking that the pH meter was broken. The latter two are considered mild by the Consortium.
Judicial use
The GHK decided in the Assembly today to impose these sanctions against the coalition abertzale.Ademas, it should be remembered that the Anerreka Environmental Association, Zubieta Lantze and Eguzki filed a complaint with the Environment Prosecutor’s Office in Gipuzkoa. The Public Prosecutor's Office considers that the dumping of Arkaitzerreka is "an alleged crime against the environment" and "the investigations it has carried out have affected 5 municipalities in Donostiarras. He has sent them to the Examining Court, which is in charge of the case. It must determine the existence of a crime against the environment.
