The exculpation of the defendants, the reduction of penalties against them or the ratification of the judgment of the National Court: among these options is the decision of the Spanish Supreme Court following the judicial hearing on Wednesday. The Supreme Court will examine in the oral hearing, three years later, the appeal filed by the imprisoned young people against the ruling of the National Court.
It is not expected that the Supreme will take a long time to make the judgment known. But it may not do so on the same day, because the Supreme, in principle, has to look at the arguments that the defense proposes. In practice, the judgment of the Supreme Court means the closure of the court in defence of young people. Subsequently, prisoners could appeal to the Spanish Constitutional Court, but what would be studied is whether the constitutional rights of the defendants have been violated in the process, not the facts. The last option would be to appeal to the European Court of Human Rights in Strasbourg (ECHR), but one of its resolutions could come too late. The decision of the Supreme is therefore decisive.
Hope and fear
“Our children are frightened and nervous,” said Bel Pozueta: “They have been in jail for three years and today may end the nightmare, or not.” He explains that parents adopt the Supreme Supreme session with caution: "The judgments we have received on this journey have been so harsh, so unfair, that we also see very carefully the one of the Supreme," he added.
