The Gastéiz Feminist Movement denounces the sentence against the aggressor of a minor
- A minor in Vitoria-Gasteiz was sexually assaulted by a minor in June 2023. The Vitoria-Gasteiz Feminist Movement does not see fair the measures that the judge has imposed on the aggressor and vice versa. He believes that the revictimization of the aggressor is being encouraged. The feminist movement has asked the ikastola of the two young people to change their schools.
In June 2023, a 14-year-old sexually assaulted a 13-year-old girl. The young woman filed the complaint at the time of the aggression, according to the same source. The sentence comes recently and prohibits the victim from approaching less than 200 meters away and communicating with her by any means, but reduces the minimum distance from school to 10 meters. The aggressor has violated this order several times in the center, one of the violations occurred in the presence of the Municipal Police. The rape was reported by the police itself, but was archived by Judge Sara Mallen Basterra, who also filed a complaint.
The Vitoria-Gasteiz Feminist Movement believes that this judicial decision violates the right to liberty and security of the girl child and to the recovery of the harm suffered. She is receiving psychological support, because aggression related violence has left her emotional distress “very significant”, and is affecting her academically.
The feminist movement does not understand that the aggressor does not change school: “In claiming these measures, we take into account the recognition of the damage caused and respect for the victim’s living space.” They have asked the ikastola and the Department of Justice and Education of the Basque Government to take these urgent measures by September.
The Vitoria-Gasteiz Feminist Movement prioritizes educational measures. For this reason, they have asked that the young assaulted have the educational resources and feel accompanied in the process of relocation. In this sense, they have claimed to be guided by ways of repairing against male violence.
