The Criminal Court No. 2 of Pamplona has acquitted four members of Indar Gorri and a citizen of Vitoria-Gasteiz. The judge has indicated that the evidence provided has not been sufficient to substantiate the facts that led to the final indictment in this case and thus to confirm that it was a crime of coercion.
The Criminal Court No. 2 of Pamplona has acquitted four members of the Red Force and an Alavese accused of coercing the fans who went to the Spain-USA party. The judge considers that there has been a "total lack of evidence", since none of the defendants attended the party, none of them went to El Sadar and among the defendants there were no Spanish T-shirts.
“It has not been possible, therefore, to verify that in the acts that were the subject of the complaint were coerced fans who identify themselves as passive subjects of coercion, who by the activity described, physically or verbally, have been intimidated, or have felt, in some way, intimidated, or have not influenced their freedom, bearing or not Spanish flags or t-shirts,” the judge said.
Thus, the judge has observed "some disturbances" that occurred in the vicinity of the football field of El Sadar. “In some cases there have been violent, verbal and physical conduct against the national police in charge of the security of the sports event, but no accusation has been received against them,” he warned.
The Prosecutor's Office called for three years of imprisonment and five years of prohibition to go less than 600 meters from El Sadar for the accused, while adding to the aggravating of "discrimination by ideology and nation".
Accordingly, the judge considers that the evidence provided has not been sufficient to substantiate the facts that led to the final indictment in this case and that, therefore, a crime of coercion has been committed.
