The Criminal Court No. 2 of Pamplona has acquitted four members of Indar Gorri and a citizen of Vitoria-Gasteiz. The judge has indicated that the evidence provided has not been sufficient to substantiate the facts that led to the final indictment in this case and thus to confirm that it was a crime of coercion.
The Criminal Court No. 2 of Pamplona has acquitted four members of the Red Forces and another of Vitoria-Gasteiz, accused of coercing the fans who went to the Spain-USA party. The judge considers that "total lack of proof" because among the accused people "no one went to see the game to El Sadar" and none of them took the shirt or flag of the Spanish football team.
Thus, the judge has observed "some disturbances" that occurred in the vicinity of the football field of El Sadar. “In some cases they were violent, oral and physical behaviors against the police in charge of the security of the sports event, but no accusation has been received against them,” he warned.
The defendants have denied in the trial that the accusation against them was based almost exclusively on the story of the police and have claimed that in the violent action charged against them there were no injuries or any formal complaints. The Prosecutor ' s Office had requested three years ' imprisonment for the defendants and five years ' prohibition of going less than 600 metres from El Sadar.
According to the judge, it has not been sufficient evidence to prove the facts imputed to him.
