Blessing of judges
In carrying out the judicial struggle, one of its main objectives is to obtain the approval of the judge. In the case of the extradition of Iratxe Sorzabal Díaz, they did so a week ago. The judges were able to cancel a request for extradition requested by the Spanish State. In total, Sorzabal issued four Euroorders: one was annulled, but the other three were previously accepted by the judges. The Basque prisoner is held in the prisons of the French state. However, Spain demands its extradition in order to judge the facts imputed to it in the Iberian Peninsula.

In cases relating to the Basque conflict, rejection of a Euroorder is not common. So why was the Spanish Euroorder unacceptable to the French judge? First of all, it may be thought that Sorzábal's torture tests showed that Spanish justice would not protect itself. However, the prisoner complied with the Istanbul Protocol to confirm the credibility of his torture, according to the statement. This international guide offers an analysis carried out through different experts. Doctors from different areas prepare a report to ensure the patient's statements. In the case of Sorzabal, although the first Euroorders were accepted, the judges did not rule out the possibility of torture. In the previous petition, the judge admitted the allegations of torture of Sorzabal, but did not withhold this argument to refuse the extradition of the prisoner. Secondly, the prisoner ' s lawyers demonstrated that Sorzabal ' s statements had been made under torture. For all these reasons, the judge rejected the last Euroorder that Spain had asked for in the referendum.
This judicial decision is a precedent. Here, a French judge has dismissed the request of a Spanish court. This shows us that in this configuration of the justice system, the judge is still the master and master. The work of the House’s lawyers has been decisive in putting an end to this latest Euroorder. Here are two new features: Use of the Istanbul Protocol and demonstration of links between confessions and torture. Court decisions may, on the contrary, affect the following cases and have therefore not been mentioned. The work of verifying and verifying torture in the CAV has been carried out in part. According to the report directed by Francisco Etxeberria, between 1960 and 2014 more than 4,000 cases of torture were recorded in the CAV and Navarra.
But now what? In order to promote individualized judicial defense, we must build a collective defense. On the one hand, an analysis of the cases throughout the Basque Country (based on the work carried out by the Euskal Memoria Foundation) and, on the other, a recognition of the violence exercised by the states. Consequently, we can achieve recognition and reparation for the victims.
