Eternal Jail
Before the slave States, when tribes were basic structures, hostilities were resolved among themselves. Since there were no measures regarding the consequences of what was done, different payment habits were constructed. Later, when the powers were centralized, they were dedicated to regulating them to gain the fear and social control of their subordinates.
The Hammurabi Code is the oldest known legislation. The basis is the law of the Talion, that is, the eye per eye. The violent nature of this regulation is understandable, both in the logic of oppressive absolute powers and in slave societies devoid of rights and full of duties.
When the first liberals, in the Enlightenment, proclaimed the freedom and equality of the individual, they also realized the ineffectiveness of the law of the Talion: it did not serve to reduce crimes, increased suffering and concealed the excesses of power.
The rights of citizens were recognized, and the State had to protect them by diminishing oppressive power. To those who broke the social contract, it was thought that the death penalty or the establishment of a life imprisonment was excessive, cruelty to the pensioner and intolerable to society. Despite the seriousness of the facts, every citizen must have the right to social reintegration under the responsibility of the State.
I believe that in recent times we are clearly going back (I do not mean the Parot doctrine in particular, because political dissent is more serious). In general, jails are to outrage and subjugate the prisoner; the legislative changes are to tighten the penalties; and if the limit was 30 years earlier, then 40 were set. It is now a life sentence. The most agitated (I saw them screaming in Madrid), once again, calling for the death penalty.
The state is recovering absolute power and there are a lot of people in favour. We lose the sense of citizenship and we are becoming happy subjects, dictators of the neighbor, pursuers of the neighbor, under the eyes of the Big Brother. To restore the Talion law, the spirit of revenge of the victims is used, while the intellectual servants create a social alarm in the media.
I do not agree. For the individual, being in prison for more than 20 years is truly inhumane, and more than 30 can only be understood from revenge, that is, it is not effective and increases suffering.
But the state, if it is of all, cannot be for revenge, but for rights. The enlightened invented this incredible story. And believe it.
