Those responsible for the Zaldibar landfill company have not testified before the judge
  • Arrate Bilbao, manager of the company and grandson of Barinaga, José Ignacio Barinaga, founder and owner of the company Verter Recycling 2002, and Juan Etxebarria, owner of the infrastructure, have been made available to the courts at noon. According to Berria, no statement has been made either before or after the arrest. The arrests took place on 21 July and the Ertzaintza has remained at the Eibar police station. However, the High Court of Justice of the Basque Country (TSJPV) has specified that the courts in Durango and Eibar that are examining the Zaldibar case do not have that order and that their arrest has been "a mere police operation".

Two courts investigate whether there was a crime at the Zaldibar landfill, where it fell on 6 February, and two are investigating. Two workers were surprised by a 1.5 million tonne waste leap and fell to the freeway; in the following week investigations began the courts: The Durango Court investigates whether this is a crime against the environment, which is already under investigation. The information initially disseminated on the arrests indicates that the arrests were ordered by the local judge, but thus denying the note issued by the Durango Court of Investigation and First Instance: "This is an operation that comes only within the scope of the National Police. This court, which has decided to carry out investigations into the facts, has not issued an arrest warrant," he said.

The second case related to the Zaldibar cascade is being investigated by the Eibar Court, which investigates whether a crime has been committed against workers and persons.

Verter Recycling 2002 believes that arrests are "illegal"

The company Verter Recycling 2002 has denounced that this is "an illegal, illegal and therefore illegal case of detention". "There is no court order to resolve this action, and the police itself has confirmed to the legal representatives of the company that the decision is yours, not the Court."

The Department of Security explains the procedure used by the Ertzaintza to carry out the arrests

The public EiTB has echoed the response of the Department of Security: "The Ertzaintza Judicial Police investigating the landslide in the Zaldibar dump made progress in the investigation known to the competent courts and prosecutors and proposed the arrest of the alleged perpetrators of the crimes under investigation." (...) "They were arrested and the competent courts and the Public Prosecutor's Office learned of this, since the transfer of detainees to the police station in Eibar was authorized and appropriate records were made."

The Zaldibar Argitu platform also asks to investigate political responsibilities

Jokin Bergara, member of the Zaldibar Argitu platform, has made these statements in the Basque Country: (Arrest) "It's good news. It has been six months since the landfill collapsed, it is late, but something seems to be moving. We would like to stress, however, that there are not only private responsibilities, but also political ones, and that they have not taken the slightest step." The President-in-Office of the Environment, Iñaki Arriola, has stressed that it is not possible to be part of the new Basque Government that is negotiating.
