- The case of the Basque dam Iratxe Sorzabal is a new or unknown issue today, according to the League for Human Rights (Ligue des droits de l'homme). Bake Bidea has also denounced the admission of the Basque Country Court of Appeal to the demands of citizens.
The Paris Court of Appeal has admitted the Euroorder requested for the third time by the Spanish National Court of Appeal. The prisoner's defence lawyer, Xantiana Cachenaute, has stated that the National Hearing is based on statements under torture made by the Sorzabal Civil Guard in 2001.
Iratxe Sorzabal was arrested in 2015. Lawyer Cachenaut asked the French examining magistrate to initiate proceedings to prove the 1995 ETA attack allegations in Alicante (Catalan Countries) against the prisoner of eta charged by the Spanish courts.
The prisoner was reportedly subjected to a medical examination procedure in Fresnes prison called the Istanbul Protocol. “In the opinion of the doctor, Sorzabal’s torture complaint is credible; he was diagnosed with post-traumatic stress,” said attorney Xantiana Cachenaut.
Garzón's lawyer believes that there is little chance of a Euroorder being suspended in the Spanish State. However, since 2016 the Court of Luxembourg of the European Union (EU) has opened a number of cases and created case law. If that is the case, the defence lawyers of the prisoner should demonstrate that the Euroorder is based on statements under torture. That would be the reason for the refusal of the application.
