30 years hidden in the light: evidence of torture
  • On 20 August 1993, around 5:00 a.m., a team of emergency health professionals from Santiago Hospital attempted to unnecessarily revitalize Juan Calvo: The bilbaíno was killed from the Arkaute police station. One of the doctors outraged the police. When he got home, he picked up everything he remembered in a two-page paper so he wouldn't forget what happened. Then, fearing its consequences, he hid it. Now he puts it in the hands of ARGIA.

The medical report and the interview, certainly crude, offered by another hospital worker have been the motors to seek new information and try to make some light in the case of Juan Calvo. Among the new materials and testimonies obtained is the official autopsy of the body of Calvo by the coroner.

The medical report presented some diagnostic errors due to the impossibility of performing the paused examination (hence the official autopsy to complete the anatomical drawings). But he correctly collected the most significant points: That Calvo’s body poured gas into the doctors with “cough, irritative conjunctivitis, dizziness and dyspnea”, which was loaded with blows, bruises and wounds, which had signs of being tied in the wrists... But the paper provides other eye-catching data.

Thanks to this report we know that the doctor asked the Ertzaines to call the Judge on Call and the Coroner to be in the hospital, aware of the gravity of what was before his eyes. But, always according to the doctor, “as nobody gave signs” called 092 on his own initiative. Finally the judge and the coroner appeared, and when the doctor told him that the Ertzaines had not wanted to call him, he answered that he had received two calls: the first, informing of a “natural” death and the second, requesting his presence. Who made the first call describing Calvo’s death as “natural”? Could someone do it other than the Ertzaintza?

Then, an hour after Calvo's death, the Judicial Commission found the audio of the situation.

ARGIA asks a professional forensic with long work experience to evaluate the medical report and official autopsy that has been hidden for 30 years. As regards the report, he points out that it is generally correct and concrete. He clarifies that the significant amount of water in his lungs is the result of edema (which could have been the cause of death in the medical report).

Finally, he notes that it is not common for doctors to adopt a “proactive” attitude of size in the face of a death (not only facilitated the presence of the judge and the coroner, but also took samples of the fluid coming out of Calvo’s mouth), and that this attitude is “positive”.

The doctor has kept the report for 30 years, written when he got home the night he tried to get Calvo back.

Analyzing the anatomical drawings and video that the ARGIA working group has formed is the best way to understand the content of the autopsy of Forensic Mercedes Sines Lafuente of the Anatomical Institute of Vitoria. In any case, he had Calvo corpses: two incisions in the head, one extending to the skull and producing a small blood spill in the brain; “large bruises” in the testicles; acute pulmonary edema; signs of clamping in the wrists; and at least 47 strokes throughout the body (supposedly drunk), nineteen hematomas and sixteen superficial tears.

The autopsy reveals that Calvo's death was "violent", a cause of the pulmonary edema mentioned, caused by the CS gas used by Ertzaintza.

According to the Medical Examiner of Vitoria, from a “strictly medical” point of view it is not possible to establish precisely whether the death was the result of an “accident”, “suicidal” or “murderous”.

According to the coroner consulted by ARGIA, the autopsy of Sines forense is “good quality”: in addition to being a very detailed study, numerous samples are taken for laboratory analysis. Strokes generally do not produce significant injuries; the posterior section of the head must be caused by a “significant” blow; bruises of the testicles probably formed by blows. As for the way of killing, forensic medicine does not rule out a documented combination of three factors on several occasions: gas + police immobilization + Calvo's rebel delirium.

Homicide

Finally, he totally disagrees with the open interpretation of the autopsy of death: he says “without a doubt” that the cause of death was not “accident” or “suicide”, so Calvo’s death is “the result of third-party intervention”. Calvo was killed in police station.
