On 30 November, the Bizkaia Provincial Court sentenced an Ertzaina to six months in jail for several fists in police custody to a racialized woman named Silvia.La, sentencing the agent for “mistreatment” due to the acceptance in trial of the Istanbul protocol and the detailed reports of forensics who proved physical and psychological injuries.

There were also "decisive" recordings in this process that have now disappeared from the archives of the Tribunal in Bizkaia. According to SOS Racism de Bizkaia, following this disappearance, the Basque Government has called for the sentence to be annulled and for the trial to be repeated from the beginning with the “suffering” it entails for the victim. The association calls for the disappearance of recordings to be investigated to the last extent and for justice and reparation to be sought for the victim.

In defense of the beggar pursued by the police

In May 2018, racist Silvia intervened in her defense against the persecution of the police wanderer at the door of a supermarket. The Ertzaintza took her to the Getxo (Bizkaia) police station, where SOS Racism denounced the “violent fist attack.” After the complaint of the woman, the agents placed the opposition, but as the event was recorded in video, the ertzainas had to step back in its version.

The Prosecutor’s Office called on the woman for eighteen months in prison for facing authority and a fine of 6,000 euros for “minor crimes of injury”. For its part, the Basque Government demanded a seven-year prison sentence for Silvia, accusing him of “attack on resistance and authority.”
