The same Provincial Court of Bizkaia, which sentenced the defendant to eleven years in prison, has taken the decision to release the defendant until the sentence is passed. The family of the child who suffered sexual abuse asked for the teacher's imprisonment on the grounds that there was a risk of leakage, according to the same source. On Wednesday, however, a hearing of this request has been held, at the request of the legal defence of the defendant. The Prosecutor's Office has agreed with the defendant's lawyer and has ruled out that the leakage may take place.

It is now up to the Supreme Court to decide on the appeal brought by the defence lawyer, which may last for a year. During that time, the former professor will remain at liberty and, as a precautionary measure, he has been removed from the passport and forced to go to court once a week.

The particular indictment disagrees with the decision and has pointed out that “because it is a serious penalty it deserved the penalty of imprisonment”, “for reasons of social alarm and, above all, for avoiding the repetition of the crime”.

Continuing sexual abuse

A former student at Gaztelueta College of Opus Dei de Leioa reported that between 2008 and 2011 the teacher had sexually abused him during two courses. The accused, aged between 12 and 13, attempted suicide as a result of sexual abuse at home and continues to seek consultation with the psychologist today.
