The Superior Court of Justice of Navarre has rejected the implementation of the Skolae co-education programme approved by the Department of Education on the grounds that there is an error in the processing. The judge has argued that he "totally" hung out of the legally established procedure, so he has called for pre-trial detention. It points out that as a cross-cutting programme, it had to be dealt with and adopted as a general provision or regulation, and not as an administrative initiative. In any case, the judgment has not yet been appealed, so an administrative appeal is ruled out.
The complaint against the Skolae programme was lodged by two parents from schools in Pamplona/Iruña. However, the Tribunal has not entered into an analysis of the details of the programme. The magistrates consider that for the process of adopting laws of a general nature it is necessary to "comply with the foral law", adding a memory to the preliminary draft and an economic investigation, and consulting all the departments. In some cases, there is an obligation to submit the project to public information. Finally, the Law determines the procedure necessary for its implementation.
Skolae is one of the main proposals of the Government of Navarra in the field of education. The programme aims to promote an “egalitarian culture” and to promote education on gender-based violence. However, right-wing social sectors have opposed and accused the Government of wanting to “indoctrinate” children.
