Supreme Court annuls sentence absolving Marixol Iparragirre
  • Marixol Iparragirre was tried for alleged ETA involvement in an attack in Vitoria in 1985 and was acquitted by the Spanish Court in March last year. The Supreme Court annuls the judgment and orders that the trial be repeated with different judges. The reason for this is that the assessment of the test related to some finger marks has been omitted.

The Supreme Court annulled the judgment of the Spanish Court of 29 March 2021, which acquitted Marixol Iparragirre of participating in an attack that ETA planned to carry out in Vitoria in 1985 but was not carried out. According to the Supreme Court, the court that issued the acquittal of Iparragirre abandoned the assessment of the dactyloscopy test associated with some fingerprints, "with unreasonable argumentation", so that it annulled the judgment and ordered the repetition of the trial with different magistrates.

Iparraguirre was tried for ETA's possible involvement in the May 1985 attack at the Mendizorrotza sports club in Vitoria-Gasteiz. Fingerprints were found in the car bomb, allegedly explosive against a police device, but there is a contradiction between what was declared by the experts who made the attack in 1985 and what the report to which reference was made in some statements. According to the experts, the car found perceptions of a single person, but also those of Iparraguirre, according to the report, "of which the judicial authority did not know until 2019".

According to the Supreme, the report containing the expert statement does not deny the existence of the bear brands of Iparraguirre, and archived them as anonymous.
