The High Court of Justice of the Basque Country resolves, at the request of the VOX, the non-demolition of the Loiola Barracks
  • The Spanish Army headquarters in the Loiola district of San Sebastian will not be demolished. This has been decided by the High Court of Justice of the Basque Country in the light of the appeal lodged by the VOX. The Mayor of San Sebastian, Eneko Goia, has pointed out that this is an "obstacle" to the development of the city and that they will appeal to the Supreme Court of Spain.

The City Hall of Donostia-San Sebastian planned to demolish the Loiola barracks and build more than 2,000 homes. The request for the transfer of the barracks was announced in 2018 and in November 2020, in exchange for the protection of Spanish budgets by the PNV, the government of Pedro Sánchez committed to ceding the lands that the army occupied in San Sebastián in the last century. With the money obtained from the sale of the former barracks, the Spanish Ministry of Defence wanted to build a new building on the grounds of the Real Sociedad Equipica. However, the High Court of Justice of the Basque Country has approved the appeal of the ultra-right party Vox and the City Hall of San Sebastian will have to protect the Loiola headquarters, including the military buildings in the Special Plan for the Protection of the Urban Heritage.

The Mayor of San Sebastian, Eneko Goia, expected before the summer to reach an agreement on the Loiola barracks. In an interview given this Thursday in Euskal Irratia, he stated that the barracks are “undoubtedly a barrier” and has assured that he will carry out an analysis with the Spanish Ministry on the future of the barracks.

In March 2021, the VOX brought to court the plan planned by the City Council of San Sebastian. Although it has been accepted, they have not done so in the form collected in the appeal, because the VOX requested the highest level of protection for the barracks, and it has not been.

At the press conference on 14 July, Mayor Eneko Goia first asked for prudence and said that they too will act in the same way. Remember that the problem they have now stems from the appeal made by the VOX, which is a party that has no representative in the City Hall of San Sebastian.

Goia also says that on 13 July he had the opportunity to speak with the ministry, and adds that his will is clear: “Make a joint reading and use the tools to be used based on the resources of each organization.” The Mayor of San Sebastian adds that they plan to carry out the project "to the end": "We will continue to work with the intention and desire to overcome the inconvenience. Because this city has a very clear goal and needs that land to be offered to the city."

It indicates that there is also uncertainty as these lands are at risk of flooding. The intention of the City Hall is to repeat what was done in the Txomin district: increase the height in the barracks area. It insists once again on the need for this land and that it will appeal directly to the Spanish Supreme Court.

It certifies that the Special Plan for the Protection of Urban Heritage is good, but that it must be compatible with the use of land. VOX says it wants the barracks to be a lifelong military use, but it ensures: "The protective patrimony has not forced this."
