He was arrested in May 2008 in Bordeaux, France, along with Xabier López Peña, Jon Salaberria and Ainhoa Ozaeta. He was tried and convicted in Paris in 2012, charged with a crime of integration into a terrorist organization in the apparatus. During the trial, Suberbiola and the rest of the defendants declared the suffering they caused in the young woman.

He spent his first years in Arlés prison, about 750 kilometers from Euskal Herria. In 2018, however, he was transferred to Mont de Marsan, in a process started with the Basque delegation in the French State. The Spanish National Court tried to transfer Suberbiola to Spain to be tried for an alleged crime of belonging to Segi, and for that reason, he was sentenced to fourteen years in prison. The French courts, however, refused to do so.
