On the allegations of torture in Grande Marlaska: "The only truth is the judicial truth"
  • The Spanish Minister of the Interior, Fernando Grande Marlaska, has questioned the report on the allegations of torture of the Basque Government. He adds that there is no judicial decision that says that 4,000 or 5,000 cases of torture have been committed.

Marian Beitialarrangoitia, a member of the EH Assembly, asks Grande Marlaska about the torture and political prisoners in the internal affairs committee. Although she does not agree with him, Beitialarrangoitia declares that she will not put “obstacles” in the dialogue with the minister.

When the MP of the EH Assembly published the report on the torture of the Basque Government, Grande Marlaska was very pessimistic and repeated several times “and if you want, you can create truths but the only truth is the judicial truth” and denies that there has been systematic torture.

The Basque deputy reminded him of the account of Beatriz Etxeberria who had suffered torture in the situation of incommunicado detention imposed by the former judge and added that she “knew him well”. On the other hand, Grande Marlaska recalls that among the things that were detected to ETA were “documents to denounce torture”.

Asked about the Strasbourg sentences, the former judge said that they did not say that there had been cases of torture, but that “there had to be a more thorough investigation.” However, in the judgment published by Strasbourg in the case of Porto and Sarasola, he admitted that the two Basque youths had been subjected to “inhuman treatment”.

Asked about political prisoners, the minister says that there was a time when this prison policy was “positive” but now it is necessary to comply with the “law”. Beitialarrangoitia adds that she feels good about this solitary treatment that the prisoners have not received until now, but that she finds it surprising that for Grande Marlaska it is “hard” to end the Parot doctrine when she considers herself a defender of the rule of law.
