A former student reported having been the victim of sexual abuse by a professor at the Gaztelueta College of Opus Dei de Leioa during two courses, between 2008 and 2011. As he explained, when he suffered abuse he was between 12 and 13 years old, and as a result of the abuses he attempted suicide and today he continues to turn to the psychologist, who turned his back on him. The investigating judge gave credibility to the complaint and the trial of the case was held between 4 and 11 October at the Provincial Court of Bizkaia.
The prosecutor, the private prosecution and the defence lawyer have made their final conclusions known in plenary. The prosecutor has stated that she considers that there have been abuses but that the most serious have not been proven, so she has applied for the slightest sentence of three years in prison, which is contained in the Spanish Penal Code in force at the time of the events. As an alternative, and on the basis of the current Spanish penal code, he has applied for a 20-month prison sentence, with which the defendant would not go to jail. The choice of one of the two options lies with the judge.
The particular accusation has been in favour of a 10-year petition for continued sexual abuse of a minor from a position of superiority.
The defence, for its part, has called for a free acquittal for the aggressor, who has attacked it.
