The defense denounces errors in the legal proceedings of G7 detainees
  • Sixteen people were tried on Friday in a trial held in Baiona (Lapurdi). The judgment will be delivered on 3 December.

Last Friday, 16 people were tried in the Baiona Court accused of participating in the protests during the G7 meeting in Baiona. The majority of those arrested were arrested at the 23 August demonstration in the Urruña Cornisa (Lapurdi) and in the 24 August incidents in Baiona Txiki, where they were brought to justice yesterday.

At noon, dozens of people gathered before the Baiona Court to report Segi's death. They shared a meal and Legal Teama will use the money raised to pay fines and attorney fees.

During the G7 meeting, a dozen lawyers were in contact with the Legal Team. Some of them made collective defence last Friday, and underlined the existence of some errors in legal proceedings. They have also stressed that errors have often been made in police documents, including the problems of dates and lack of signature. More than one of the defendants has said that they have been subjected to police violence in the arrests: A man arrested in the Urruña cornice has said that the glasses were lost and that the police "exploded them intentionally", according to sources from the Department. The lawyer has requested the withdrawal of the charges and the invalidity of the charges.

In the rest of the cases there have also been violations of rights: the defendants have been denied the chosen lawyers and their rights have been communicated to them too late during the detention. In principle, the accused must know within 45 minutes of his arrest what his rights are, which were sometimes granted within three hours.

Although the Prosecutor ' s Office has not accepted the annulment of the files, in most cases it has requested the withdrawal of charges. The highest request was a fine of EUR 300. However, he has asked a young person for an eight-month prison sentence for alleged criminal background offences. In the face of these mistakes, lawyers have asked the judge to withdraw his charges. Furthermore, they have denounced that "violations of rights" have occurred by the defendants. It has also been similar in the case of other defendants. The prosecutor has not invalidated the dossiers, but has called for the withdrawal of the charges and has called for fines of between EUR 150 and EUR 200.

The issue at the political level

Lawyers who have exercised collective defense have told the judge that these are "procedural defects that had never been seen." They have also indicated that this is a political issue. For example, a defendant’s lawyer has accused the judge of having been preparing for months how to manage possible arrests during the G7: "It's been several months since you were conditioned to be ready at the time of the G7 meeting. It looked like an apocalypse, and it hasn't. Another attorney has accused the prosecutor of acting "outside of democracy": "Is it possible to stop political opponents without charges in a democracy?" ". The public has been pleased with the work done by the defence lawyers. The Baiona Court will decide on 3 December next in the Congress of Deputies.

This week, for its part, the Baiona Court will judge another six people in connection with the protests of 23 and 24 August. The trial for these events will also continue during October and December. On 9 September, for its part, the Dax (Occitania) court sentenced two people for murder offences. The five defendants, who must serve a six-month prison sentence for some reversibly painted women, have been imprisoned.

After the trial, a support evening was held at the Baiona Epaixka (Lapurdi). The money collected will be used to pay the costs of justice for the defendants.
